PLEASE READ CAREFULLY BEFORE BOOKING OR PARTICIPATING.
By booking and/or participating in any trip, charter, or guided tour with Nanny’s Revenge, the undersigned (“Group Representative”) affirms and agrees to the following on behalf of themselves and all members of their party:
1. Acknowledgement of Risk
I understand that even though safety is the #1 priority for all experiences and trips at Nanny's Revenge, participation in activities such as fishing charters, sightseeing trips, cruises, ash scattering, and other water-based experiences, activities, and/or charters involves inherent risks, including but not limited to:
Changing weather or sea conditions
Slips, falls, or collisions
Equipment malfunction or misuse
Wildlife or fishing-related injuries
Drowning or other serious water-related hazards
Injury and the possibility of death
I and all members of my party voluntarily choose to participate and accept full responsibility for these risks.
2. Assumption of Responsibility
I acknowledge that myself and each participant in my charter, listed or unlisted, on the booking form and waiver is physically fit to participate and is voluntarily engaging in the chosen activities. Myself and all participants understand they must follow all instructions and safety guidelines provided by the captain and crew. Failure to do so may result in removal from the trip or immediate dismissal at any point in the experience WITHOUT refund or compensation.
3. Release of Liability
In consideration of being allowed to participate, I, on behalf of myself and all members of my party, hereby waive, release, and hold harmless Nanny’s Revenge, Captain Shane Gentry, its owners, operators, captain, crew, and any affiliates from any and all liability, claims, demands, or actions arising from injury, illness, death, or property loss or damage, whether caused by negligence or otherwise.
This waiver applies to all trips and services, including but not limited to:
Full-day and half-day fishing charters
Walk-on group fishing trips
Cruises to the Cape
Sightseeing tours and water excursions
Clamming, cast netting, sightseeing, and any custom outings listed or not listed on this site or elsewhere.
4. Emergency Medical Treatment
In the event of an emergency, I authorize the captain or crew to secure medical treatment for any member of my party if necessary. I understand I am responsible for any related expenses.
5. Personal Property Disclaimer
I acknowledge that Nanny’s Revenge is not responsible for loss or damage to personal items brought on the vessel or during any trip.
6. Representation
I affirm the following:
Each member of the group has read, understands, and agrees to the terms of this waiver.
All participant names will be listed on the booking form and all participants will sign before boarding Nanny's Revenge unless otherwise unable or underage.
Any minor or other participant unable to sign this waiver shall be represented by myself or another legal signer/participant or legal guardian or legal representative and I understand that this waiver shall apply to every participant/individual boarding the vessel Nanny's Revenge, as if they had signed it personally.
7. Signature
By signing below, I acknowledge that I have read and I understand this waiver and that I accept it and agree on behalf of myself and/or each member of the party that I legally represent or I am the legal guardian of. I understand that this is a legally binding release of liability.
EVERY PARTICIPATING MEMBER AND PERSON BOARDING NANNY'S REVENGE ON THE SCHEDULED CHARTER MUST SIGN BELOW, UNLESS UNABLE OR REPRESENTED BY ANOTHER PARTY MEMBER.
